GENERAL SALES CONDITIONS
1. Purpose and acceptance of the terms and conditions :
The Fournival company website Altesse SAS (hereinafter referred to as the "Site") is an e-commerce site accessible via the Internet at www.altesse-studio.com. It is open to all
users of this network (hereinafter referred to as the "Internet User").
It is published by Fournival Altesse SAS (hereinafter referred to as "the seller"), a simplified joint stock company with capital of 550,000 euros, whose registered office is at 211 rue de l'abattoir, 60250 Mouy, registered with the Beauvais Trade and Companies Register under number 487 577 462 00012. The Site is hosted by Shopify Inc, whose registered office is located at 126 York St. Ottawa, ON K1N 5T5, Canada.
This Site enables Fournival Altesse SAS to offer hairbrushes for sale to Internet users browsing the Site. For the purposes hereof, it is agreed that the User and Fournival Altesse SAS will be collectively referred to as the "Parties" and individually referred to as the "Party", and that the User having validated an order will then be referred to as the "Buyer". The rights and obligations of the User necessarily apply to the Buyer.
Any order for a Product offered on the Site implies consultation and express acceptance of these general terms and conditions of sale, without this acceptance being conditional on a handwritten signature by the User. In accordance with the provisions of articles 1316 to 1316-4 of the French Civil Code, supplemented by Decree n° 2001-272 of March 30, 2001, taken for the application of article 1316-4 of the French Civil Code and relating to electronic signatures, it is hereby recalled that the validation of the order form, as specified in article 4 of the present general terms and conditions of sale, constitutes an electronic signature which has, between the Parties, the same value as a handwritten signature.
It is specified that the User may save or print these general terms and conditions of sale, provided that they are not modified.
Fournival Altesse SAS reserves the right to modify the present General Terms and Conditions of Sale at any time, without prior notice, it being understood that such modifications will be inapplicable to reservations and orders previously accepted and confirmed by the purchaser. These conditions apply to the exclusion of any other document.
2. Products sold on the site www.altesse-studio.com:
In accordance with Article L. 111-1 of the French Consumer Code, the Purchaser may, prior to
placing an order, review the essential characteristics of the product(s) he/she wishes to order on the www.altesse-studio.com website.
The photographs, graphics and descriptions of the products offered for sale are indicative only and in no way binding on the vendor, and remain the property of Fournival Altesse SAS.
In the event of unavailability of one or more products after an order has been placed, the Buyer will be notified by e-mail. The amount of the order will then be recalculated and the Buyer will be debited with the new amount, less the missing product(s). If the order is completely unavailable, the Buyer will be notified by e-mail and will not be debited.
3. Prices for products on sale on the site :
The prices shown on this Site are in Euros, all taxes included, and are subject to change during the year, it being understood that the products ordered are invoiced at the prices in force when the order is registered.
Prices do not include shipping costs, which will be calculated according to the amount of the order and invoiced in addition to the price of the products purchased. Shipping costs will be indicated before the Buyer validates the order.
Prices include the value-added tax (VAT) applicable on the day of the order. Any change in the VAT rate will automatically be reflected in the price of products sold by Fournival Altesse SAS on its website.
Fournival Altesse SAS reserves the right to modify product prices at any time.
4. Orders:
Any order implies unreserved acceptance of these terms and conditions of sale. Prior to placing an order, the purchaser declares that the purchase of products on the Fournival Altesse SAS website is not directly related to a professional activity and is limited to strictly personal use, and that he/she has full legal capacity, enabling him/her to commit to the present terms and conditions of sale. This acknowledgement of receipt will specify the exact amount invoiced and the terms of delivery of the order.
The Buyer may check the details of his/her proposed order and correct any errors. As soon as the Buyer confirms his/her order by clicking on the "Confirm your order" icon, he/she is considered to have accepted, with full knowledge of the facts, the present general terms and conditions of sale, and the prices, volumes and quantities of the products offered for sale and ordered by the Buyer.
As soon as the order has been registered, a detailed acknowledgement of receipt will be sent to the Buyer, to the e-mail address indicated. The sale will only be considered final after Fournival Altesse SAS has made this order confirmation available to the Buyer and
has received payment in full.
Fournival Altesse SAS recommends that the Buyer keep the information contained in the order confirmation sent by Fournival Altesse SAS on a paper or computer document.
Fournival Altesse SAS reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order, or for any other legitimate reason relating in particular to the abnormal nature of the order.
5. Payment:
All orders are payable in euros (€), all taxes and compulsory contributions included. Any bank charges (such as exchange commissions) remain the responsibility of the Buyer, including in the case of a refund.
Full payment must be made when the Buyer places the order online. At no time may the sums paid be considered as deposits or advance payments.
To pay for his/her order, the Purchaser has the following methods of payment: credit card, which must be issued by a banking or financial institution, and Paypal account.
The Purchaser guarantees Fournival Altesse SAS that he/she has the necessary authorizations to use the method of payment he/she has chosen, when registering the order form.
Fournival Altesse reserves the right to suspend or cancel any order and/or delivery, whatever its nature and level of execution, in the event of non-payment of any sum due by the Buyer or in the event of a payment incident.
Penalties of an amount equal to the legal interest rate plus five points are automatically applicable to amounts unpaid at the end of a period of ten days following the invoice date, or upon notification of rejection of bank payment for any other means of payment.
Delivery of any new order may be suspended in the event of late payment of a previous order, notwithstanding the provisions herein.
As part of the fight against Internet fraud, information relating to your order may be transmitted to any third party for verification.
In order to ensure the security of payment by credit card, the purchaser is obliged to transmit to Cyberplus the visual cryptogram (CVV) of his/her credit card.
Fournival Altesse reserves the right to request a photocopy of the Purchaser's identity card and/or credit card (front only) for any payment by credit card.
6. Order delivery:
Delivery will be made within an average of 2 to 5 working days from receipt of the order form, depending on the delivery method chosen, subject to stock availability at the time the order is placed.
7. Product returns and refunds:
Products may be returned by the Buyer under the conditions and according to the instructions below:
- the product is clean and in good condition
- the product is in its original box with protective foam
- the product has not been subjected to intensive use or modification of any kind (customization or other)
Fournival Altesse SAS accepts the return of any item purchased on the site if it is returned within 14 calendar days from the date of receipt of the order by the Buyer.
In principle, the cost of return postage is borne by the Purchaser. In the case of a technical anomaly or an error in the references delivered, the return costs will be reimbursed by Fournival Altesse SAS.
To return an item, the Buyer must follow the instructions below:
1- Send the return request by e-mail to [email protected],
2- A return label will be sent to you
3- Place the product in a properly sealed parcel to prevent damage in transit, then affix the label to your parcel,
4- Drop off the parcel at a post office
In the absence of compliance with the procedure set out above and the time limits indicated, the Buyer may not make any claim for non-conformity or apparent defect of the products delivered, the products then being deemed to be in conformity and free of any apparent defect.
You will receive a refund of your order within 3 days of receipt of your parcel at our factory.
8. Right of withdrawal :
In accordance with article L. 221-18 of the French Consumer Code, the Buyer has a period of
14 days from receipt of the goods, except where excluded by law, to inform the Seller that he is exercising his right of withdrawal.
The right of withdrawal shall not apply to products that the Buyer has opened and that cannot be returned for reasons of hygiene.
The Buyer shall return the products without undue delay and, in any event, no later than 14 days after he has communicated his decision to withdraw. This deadline is deemed to have been met if the products are returned before the 14-day period has expired.
The direct costs of returning the products will be borne by the Buyer.
The Seller will reimburse all payments received from the Buyer, including delivery costs (with the exception of additional costs arising from the fact that the Buyer has chosen, where applicable, a delivery method other than the less expensive standard delivery method offered). Fournival Altesse will proceed with the refund using the same means of payment as that used by the Buyer for the initial transaction, unless the Buyer expressly agrees to a different means; in any event, this refund will not incur any costs for the Buyer.
Products must be returned to Fournival Altesse SAS in perfect condition for resale, in their original state (packaging, accessories, instructions, etc.), duly sealed and accompanied by a copy of the invoice, in accordance with the procedure described in article 7 of these GTCS.
If the above conditions are met, reimbursement will be made on the day the goods are collected.
9. Reservation of ownership :
Fournival Altesse SAS retains full ownership of the products sold until full payment has been received, in principal, costs and taxes included.
10. Liability :
Fournival Altesse SAS cannot be held responsible for the non-performance of the contract in the event of stock shortage or unavailability of the product due to a case of force majeure, disruption or total or partial strike, notably of postal services and means of transport and/or communications.
Fournival Altesse SAS cannot be held responsible for any indirect damage that may arise from the purchase of products.
Fournival Altesse SAS cannot be held responsible for any loss of data or files. It is the Buyer's responsibility to make all necessary backups.
Fournival Altesse SAS declines all responsibility:
- for any interruption of the site;
- for any malfunction
- for any inaccuracy or omission concerning the information available on this site
- for any damage resulting from fraudulent intrusion by a third party leading to a modification of the information made available on the site.
- and more generally for any direct or indirect damage, whatever the cause, origin, nature or consequences.
This includes, in particular, costs that may arise from the acquisition of goods offered on the site, loss of profits, customers, data or any other loss of intangible assets that may arise from anyone's access to the site or the inability to access it or from the credit given to any information coming directly or indirectly from the latter.
11. Intellectual property :
In accordance with the laws governing the ownership of literary and artistic rights or other similar rights, this Site and all elements, trademarks, designs, models, logos, graphics etc. found on this Site as well as their compilation are the exclusive property of Fournival Altesse SAS, the latter granting no license, nor any right other than that of consulting the Site.
The reproduction or use of all or part of these elements is authorized solely for the purposes of information for personal and private use, any reproduction and any use of copies made for other purposes being expressly prohibited. Any other use is
constitutive of counterfeiting and punishable under the Intellectual Property Act, except with the prior written authorization of Fournival Altesse SAS.
12. Applicable law and jurisdiction :
Sales of Fournival Altesse SAS products are subject to French law. Any dispute relating to the interpretation, performance or breach of contract between Fournival Altesse SAS and the Buyer, even in the event of multiple claimants, shall, in the absence of amicable agreement, be subject to the exclusive jurisdiction of the Commercial Court of Beauvais.
13. Information technology
- Freedom and confidentiality :
The information collected by Fournival Altesse SAS at the time of any order of the Purchaser is necessary for the management of its order by Fournival Altesse SAS and its commercial partners. In accordance with the law "Informatique et Libertés" n° 78-17 of January 6, 1978, the Purchaser has a right of access, of correction, opposition and suppression with the data relating to it near Fournival Altesse SAS while addressing to the customer service:

14. Confidentiality :
Fournival Altesse SAS undertakes not to communicate to any third party any information concerning the Buyer without his prior authorization and not to use this information for commercial purposes.
15. Unique Identification Number (UID) :
The Unique Identification Number (IDU) is proof for producers that they are registered with the LEKO eco-organization and up to date with their ecocontributions, as required by law. The IDU is used to facilitate monitoring and control of compliance with the EPR (Extended Producer Responsibility) obligations incumbent on producers.
